Opinion analysis: Justices strike down federal sports gambling law (Updated)

The 10th Amendment provides that, if the Constitution doesn’t either give a power to the national government or take that power away from the states, that power has been reserved for the states or the people themselves. The Supreme Court has long interpreted this provision to bar the federal government from”commandeering” the countries to enforce federal laws or policies. Now the justices ruled that a federal law which bars states from legalizing sports betting violates the anti-commandeering philosophy. Their choice not only opens the door for states around the country to allow sports gambling, but it also can give considerably more power to states generally, on topics which range from the decriminalization of marijuana to sanctuary cities.
The federal law at issue in the case is the skilled and Amateur Sports Protection Act, which dates back to 1992. The legislation, called PASPA, bans most nations from (among other things) authorizing sports gambling; it carved out an exception that could have allowed New Jersey to establish a sports-betting scheme in the state’s casinos, provided that the state did so within a year. The National Collegiate Athletic Association and the four major professional sports leagues went into court, arguing that the 2012 law violated PASPA. The lower federal courts agreed, prompting the New Jersey legislature to return to the drawing board. In 2014, it passed a new law which rolled back present bans on sports betting, at least as they applied to New Jersey casinos and racetracks. The NCAA and the championships returned into court, asserting that the new law also violated PASPA, and the U.S. Court of Appeals for the 3rd Circuit again ruled against the nation.
The Supreme Court agreed to consider that the nation’s constitutional challenge to PASPA, and now the court reversed. Congress can control sports betting directly, but when it elects not to do so, every State is free to act by itself.”
Justice Clarence Thomas filed a concurring opinion in which he focused not on the substance of this court’s ruling but instead on a rather abstract legal question: the viability of the court’s present severability doctrine. Thomas made clear that he combined the majority’s decision striking down most PASPA because”it gives us the best answer it can to this question, and no party has asked us to apply a different test.” But he suggested that the court should, at some stage in the future, reconsider its severability philosophy, which he characterized as”dubious.” First, he observedthe doctrine is against the tools that judges normally use to interpret laws because it requires a “`nebulous inquiry into hypothetical congressional intent,”’ teaching judges to attempt and figure out what Congress would have wanted to do if a part of a law violated the Constitution, when”it appears unlikely that the enacting Congress had any intention on this query.” Secondly, he continued, the doctrine”frequently requires courts to weigh in on statutory terms that no party has” a legal right to battle.
Justice Ruth Bader Ginsburg filed a dissenting opinion. Ginsburg didn’t elaborate on her obvious decision (joined in full by Justice Sonia Sotomayor) which PASPA’s pub on the authorization of sports betting by the states does not violate the Constitution. BIG MARLEY’S UFC FIGHT NIGHT 135 DRAFT KINGS FANTASY BREAKDOWN

This weekend we’ve got a 13-fight card after that extended 3-week break. I’m excited to have UFC back and that I am ready to win some cash on Saturday. The card will occur in Lincoln, Nebraska and there are no fighters creating their UFC introduction so it’s always nice when you’re already acquainted with all the fighters on the card. Since this is a Fight Night card, the DraftKings competitions are not the best, but there is still a lot of money to be obtained. I will be chasing the large $15k top prize at the $8 GPP as well as the $5 & $10 Qualifiers. Most of my investment will be in money games, largely H2Hs, but I will be taking numerous shots at those big prizes. Here are a few plays I enjoy this week as well as my fade of the week:
Money Game play of this week — Stack (James Vick $8,600 AND Justin Gaethje $7,600)
This is how I’ll be starting my money lineup. I can put in Vick and Gaethje then figure the rest out from there. Any fight Gaethje is in is full of activity and his three UFC fights have been Fight Of The Year type fights. Those types of fights are great for DraftKings. Notably cash games since we can lock in a win and get all the points in the best fight on the card. Normally 4 wins will find the job done in cash games and we will get over 100 points on this battle. So, with that win locked in, we just have to find 3 other people we feel good about.
GPP drama of the week — Bryan Barberena ($9,500)
It is challenging to need to pay $9.5k to get a guy like Barberena if you can just pay an additional $200 to get a -1000 preferred in Anders. However, I believe that’s what most folks will do and that is what makes Barberena a fantastic GPP play. I believe we will get him at a marginally lower ownership as a consequence of his massive salary, and he’s got an excellent shot at getting a 1st round win. If he can find a 1st round KO then he’ll have 100 points so he’ll pay off that large salary. If you think Ellenberger is totally faded, I believe that you should find some Barberena in your lineups. His ITD line is -170 and Ellenberger looks like he’s a shell of his old self. I believe Barberena does pick up a finish inside this struggle so that I will throw him some GPPs and expect he’s under possessed.
Underdog drama of the week — Andre Fili ($7,500)
This is merely the easy value play of the week. Presently, Fili is the betting favorite at -115 over Michael Johnson at +105. But, MJ is $8.7k on DraftKings and Fili is only $7.5k. I love taking that value when it’s available so I think he’s in play in all formats. He will be popular in tournaments together with all the value we are becoming on him, but I am willing to eat that chalk and I do not want to get burnt by entirely fading that value. I do think this is the toughest struggle on the card to call, but when Fili keeps using his wrestling I think he will have a good shot at winning this battle. If the fight stays standing for 15-minutes, I’d prefer MJ although not by a lot. At $7.5k we do not require a huge score from Fili so any win will likely do the trick. I am not going to pass up on this respect and I think he is the simple underdog of the week on DK.
Fade of this week — Drew Dober ($8,900)
This may just be my personal prejudice but I am not going to possess Drew Dober in any of my main ~20 GPP lineups. Nor will I have him in my cash lineup. Dober has just proceeded for takedowns in 1 of his UFC fights so he is mainly just looking to attack. I believe this will be a striking battle also and I think it’s going to be closer than the odds indicate. At $8.9k I believe we’ll need a finish from him to end up on the winning GPP lineup and that I don’t see that happening. Should you think Dober can get a KO, then you should be playing him. I will only be paying up someplace because I am not sure he can get that finish and I wouldn’t be shocked if he lost the fight. Women’s flyweights Paige VanZant and Poliana Botelho will clash at this event. VanZant (8-4) is 5-3 at the UFC and is coming from a submission win over Rachael Ostovich. Botelho (7-2) is 2-1 in the UFC but dropped by submission to Cynthia Calvillo in her final struggle. I would undoubtedly favor VanZant for the win here and based on her fame that I would not be shocked if the lineup was hugely skewed in her favor.
Wilson Reis vs. Alexandre Pantoja, UFC 236
In a rare flyweight fight, Wilson Reis takes on Alexandre Pantoja. Reis (23-9) is 7-5 at the UFC and defeated Ben Nguyen by decision in his final bout. Pantoja (20-3) is currently 4-1 at the UFC and is coming off of two straight wins over Brandon Moreno and Ulka Sasaki. Reis is a good veteran but all the upside is using Pantoja and I expect him to be a small favorite at open. Expect the failure of this fight to be released because the UFC cuts virtually every flyweight coming from a loss.
Ovince Saint-Preux vs. Nikita Krylov, UFC 236
In a rematch nobody asked , Ovince Saint-Preux takes on Nikita Krylov at a light heavyweight bout. St-Preux (23-12) is 11-7 at the UFC and is coming from a decision loss to Dominick Reyes. He’s a gatekeeper at 205lbs and is no more a true title contender. Krylov (24-6) is 6-4 at the UFC and was submitted by Jan Blachowicz in his final bout. OSP and Krylov previously met at UFC 171 in 2014, with OSP winning by submission. I am not exactly sure why the UFC felt this rematch was necessary, but given their first battle went and how bad Krylov’s entry defense is, I’d favor OSP to overcome him once again.
Montel Jackson vs. Andre Soukhamthath, UFC 236
And lastly, bantamweights Montel Jackson and Andre Soukhamthath match. Jackson (7-1) lost a decision to Ricky Simon in his UFC debut but bounced back well with a submission win over Brian Kelleher. Soukhamthath (13-6) is just 2-3 from the UFC but conquer Jonathan Martinez by choice in his final fight. Soukhamthath is too inconsistent to trust, and I expect Jackson to be favored here.
